City of Taunton Policy Statement “A Drug Free Work Place” Policy

Pursuant to Code of Federal Regulations Certification of a Drug Free Work Place.

The city of Taunton hereby Acknowledges and will comply to the requirements of the Drug Free Work Place Act of 1988. This legislation requires contractors and grantees who receive monies form Federal Agencies to certify that they will maintain a “Drug Free Work Place”.

Whereas, the City of Taunton will prohibit the unlawful manufacture, distribution, dispensing, possession, and/or use of a controlled substance in the work place.

Whereas, the employee must notify the employer of any criminal drug statue conviction for a violation occurring in the work place no later than five (5) days after such conviction.

Whereas, the employee shall abide by this policy statement.

The following actions will take place by the City of Taunton for violations of the Policy Statement titled “Drug Free Work Place”

Whereas, the City of Taunton will require employees who are convicted of drug related offenses to participate in drug rehabilitation programs.

Whereas, the City of Taunton will provide information and referral to substance abuse counseling, detoxification, rehabilitation, and/or other pertinent programs to employees at risk.

Whereas if an employee fails to participate in the program to maintain a drug free work place, fails to avail him or herself to substance abuse assistance programs or fails to notify of work place drug status convictions in the allotted time period stated, this will be just cause for termination.

The City of Taunton, through its Department of Human Services, will establish and provide a drug free work place awareness program to inform employees of the dangers of drug abuse in the work place.

Definitions:

  • A. Controlled Substance – Defined by schedules I through V of the Controlled Substances Act
  • B. Conviction – a finding of guilt (including a plea of nolo contendere) or imposition of sentence, or both, by and judicial body charged with the responsibility to determine violations of the federal or state criminal drug statues.
  • C. Criminal Drug Statute – a federal or non-federal criminal statue involving the manufacture, distribution, dispensing, possession, or use of any controlled substance.
  • D. Drug Free Work Place – a site for the performance of work done in connection with a specific contract at which employees of the contractor are prohibited from engaging in the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance.
